Terms of Service
These Terms of Service govern your access to and use of XaadFX. By creating an account, subscribing, or using the service, you agree to these Terms.
1. XaadFX service
XaadFX is a software workspace for trading journaling, planning, review, backtesting, performance analysis, reflections, goals, and related recordkeeping. Features may be changed, improved, added, or removed over time.
2. Not financial advice
XaadFX is a journaling and analytics tool. It does not provide personalized investment, financial, legal, tax, brokerage, or trading advice, and it does not guarantee trading results. Trading and investing involve risk, including possible loss of capital. You remain responsible for your trading decisions.
3. Accounts and eligibility
You are responsible for providing accurate account information, keeping your credentials secure, and all activity performed through your account. You may not use another person's account without permission or use XaadFX for unlawful, fraudulent, abusive, or unauthorized purposes.
4. Subscriptions and billing
Some XaadFX features require a paid subscription. The applicable price and billing period are shown before checkout. Payments are processed by a third-party payment provider. Unless otherwise stated at checkout, a recurring subscription continues until canceled. You are responsible for any applicable taxes or charges associated with your purchase.
5. Cancellation
You may cancel a recurring subscription through the cancellation method made available for the service. Access may continue through the remainder of an already-paid billing period unless otherwise required by law or stated during checkout. Refund eligibility, if any, is determined by applicable law and any refund terms presented for the purchase.
6. Your content and journal data
You retain responsibility for the information you enter into XaadFX. You grant XaadFX and its service providers the limited rights necessary to host, process, transmit, back up, and display that information solely as needed to operate and support the service. Do not upload content you do not have the right to use.
7. Acceptable use
You may not attempt to compromise XaadFX security, bypass subscription controls, interfere with the service, scrape or overload the service in an abusive manner, reverse engineer protected parts of the service except where law permits it, introduce malicious code, or use XaadFX to violate law or the rights of others.
8. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, outages, provider failures, security issues, or product changes may temporarily affect availability.
9. Third-party services
XaadFX may rely on or link to third-party services, including authentication, cloud hosting, payment processing, and chart or website links entered by users. Third-party services are governed by their own terms and policies, and XaadFX is not responsible for third-party products outside its control.
10. Disclaimer of warranties
To the maximum extent permitted by law, XaadFX is provided on an “as is” and “as available” basis without warranties of guaranteed profitability, trading accuracy, uninterrupted availability, or fitness for a particular trading outcome.
11. Limitation of liability
To the maximum extent permitted by applicable law, XaadFX will not be liable for trading losses, lost profits, lost opportunities, decisions made from journal data, third-party service failures, or indirect, incidental, special, consequential, or punitive damages arising from use of the service.
12. Suspension or termination
XaadFX may restrict or terminate access when reasonably necessary to protect the service, users, payment integrity, security, or legal compliance, including for material violations of these Terms.
13. Changes to these Terms
We may update these Terms as XaadFX changes. Updated Terms will be posted with a revised effective date. Continued use after an update may constitute acceptance where permitted by law.
